1301 Apartments
The Arizona Residential Landlord and Tenant Act, Arizona Revised Statutes Section 33-1301 through 33-1381, governs apartment leases and other residential leases in Arizona. If the tenant violates the lease or an obligation imposed by the Act, the landlord may give the tenant a written notice describing the events that breached the rental agreement and that the tenancy will terminate if the tenant does not remedy the breach within the applicable time period.
Breach of Lease - Notice and Cure Periods
Naturally, failing to pay rent constitutes a breach of the lease. A tenant has five days after receipt of a default notice to pay rent. Landlords may also terminate a lease for any other “material noncompliance” by the tenant with the rental agreement that the tenant does not cure within ten days. Material noncompliance includes providing untrue or misleading information on the rental application about the number of occupants, pets, or the tenant’s income, employment or criminal records.
